1. Interpretation
1.1 In these conditions the following words have the following meaning:
The Buyer: the person(s), firm or company who purchases the Goods from the Company.
The Company: Selah Ltd t/a Mobcater Catering.
Contract: any order forming a contract between the Company and the Buyer for the sale and purchase of the Goods, incorporating these conditions.
Delivery Point: the place where delivery of the Goods is to take place under condition 4.
Goods: any goods agreed in the Contract to be supplied to the Buyer by the Company.
1.2 References to any statute shall be construed as a reference to that statute as amended or re-enacted.
1.3 Headings will not affect the construction of these Conditions.
2. Application of Terms
2.1 Subject to any variation under conditions 2.3 the Contract will be on these Conditions to the exclusion of all other terms and conditions.
2.2 These Conditions apply to all the Company’s sales and any variation shall have no effect unless expressly agreed in writing.
2.3 No order placed by the Buyer shall be deemed to be accepted by the Company until the Company delivers the Goods to the Buyer.
2.4 Any quotation is valid for a period of 10 days only from its date.
2.5 Placing an order is taken as authorisation for the Company to approach third parties for credit information.
2.6 The Company may assign this contract to third parties without the buyers consent.
2.7 Commercial Intent: MobCater is a specialist supplier of commercial and mobile catering equipment. By placing an order, it is understood that the Goods are being purchased for use in a trade, business, start-up, or professional capacity. If you are purchasing as a private consumer for non-business use, you must notify us in writing before dispatch so that the appropriate consumer documentation can be provided.
3. Description
3.1 The description of the Goods shall be as set out in the Company’s Web Page and Catalogue.
3.2 All drawings and specifications are published for the sole purpose of giving an approximate idea of the Goods and will not form part of this Contract.
4. Mail and Web Order Delivery
4.1 Orders placed before 3pm for stocked items are usually delivered the next working day on U.K Mainland.
4.2 Remote areas (Highlands, Islands, NI) may incur supplementary delivery costs.
4.3 All products are subject to availability.
4.4 Delivery dates are estimates and time for delivery shall not be made of the essence.
4.5 Prices include delivery to the door (ground floor only). Delivery does not include negotiating stairs, unpacking, or positioning. The Buyer must ensure products fit through doorways.
4.6 The Company will not be liable for any consequential loss caused by delay in delivery.
4.7 Delay in delivery will not entitle the Buyer to cancel the order.
4.8 The Buyer must ensure someone is on site to sign for delivery. Signatures are binding.
4.9 If the Buyer will not accept delivery or instructions are not provided, risk passes to the Buyer and the Company may store the Goods at the Buyer’s expense.
4.9.4 For large machinery, refrigeration, or bulky items, where a delivery attempt has been made and failed due to customer error (including but not limited to: no one on site, restricted access not disclosed, or refusal of delivery), an Abortive Delivery Charge will be applied. This charge must be settled before re-delivery is attempted.
4.10 Delivery Access: Unless otherwise agreed in writing, all large equipment deliveries are ‘Kerbside’. This means the Goods will be delivered to the nearest safe point on the public highway. The Buyer is responsible for ensuring they have the manpower to move the Goods from this point into their premises.
5. Delivery and Installation
5.1 The company shall not be liable for damage caused by reasons beyond its control during installation.
5.2 Estimated delivery dates are not binding.
5.3 Storage may be charged at 2% of invoice value per month if delivery is delayed by the Buyer.
5.4 Abortive delivery costs will be charged to the Buyer if delivery is refused without notice.
5.5 Partial deliveries are permitted.
5.6 Risk passes to the buyer on delivery.
5.7 Damage occurring after delivery but before installation completion is the Buyer’s responsibility to pay for repairs.
5.8 The Buyer is responsible for protecting equipment after delivery.
5.9 No liability for fixing by third-party contractors.
5.10 No liability for loss of contents (food) due to malfunction.
5.11 Quotations exclude electrical, plumbing, or building works unless specified.
5.12 Ambient temperature requirements must be met for refrigeration equipment.
5.13 Buyer-provided materials must be in good condition.
5.14 The Company may substitute materials of similar quality if specified items are unavailable.
5.15 Force Majeure applies to delivery delays.
5.16 Buyer should insure equipment against fire and theft immediately upon delivery.
6. Returns
6.1 Goods are supplied for commercial use and are not supplied on a ‘sale or return’ or ‘trial’ basis. For business and trade orders, returns for ‘change of mind’ are not accepted.
6.2 The Company reserves the right to impose an administration charge on all returns. Due to the high cost of carriage and handling, a restocking fee of 25% of the gross invoice value may be incurred if it is necessary to return large items.
6.3 Cancellations are only accepted if agreed in writing by the Company and may incur a fee.
6.4 Returns are at the Company’s discretion within 30 days, provided goods are unused and in original packaging. Authorisation must be obtained via 01923 599 077.
6.5 Special order, embroidered, or engraved items are non-returnable unless defective.
6.6 For installed goods, contact the returns line for a decision.
6.7 Original packaging must be intact; charges apply for damaged packaging.
7. Shop and Collection
7.1 Risk in the goods passes to the Buyer upon receipt.
8. Non-Delivery
8.1 Company records of dispatch are conclusive evidence of quantity received.
8.2 Claims for non-delivery must be made in writing within 7 days of expected delivery.
8.3 Liability is limited to replacement or credit note.
8.4 Damage must be reported at the time of delivery.
8.5 Failed delivery attempts due to customer error will incur a re-delivery charge.
9. Age Related Products
9.1 Buyers must confirm they meet the legal age limit for restricted goods.
10. Samples
10.1 Samples are chargeable and must be returned in original condition for credit.
11. Leasing
11.1 Leasing is subject to the terms of the third-party lessor.
12. Risk/Title
12.1 Title remains with the Company until paid in full, but risk passes on delivery.
12.2 Right to possession ceases upon insolvency or non-payment; the Company may enter premises to repossess Goods.
13. Price
13.1 Prices are as set on the website, exclusive of VAT and carriage.
13.2 Prices may change at any time.
13.3 Variations to specifications must be approved in writing and may incur extra costs.
13.4 Extra charges apply if the site is not ready or accessible on the ground floor.
13.5 Extra costs due to lack of instructions or abortive deliveries will be added to the price.
13.6 Buyer is responsible for any taxes imposed by authorities.
14a. Payment
14.1 Payment is required before order acceptance unless credit terms are agreed (30 days from invoice).
14.2 No payment is deemed received until funds are cleared.
14.3 No set-off or counterclaims permitted.
14.4 Interest on late payments is charged at 8% above base rate.
14.5 Administration fees apply to returned cheques.
14.6 Ownership does not pass until full payment is received.
14b. International Sales and Export VAT
14.b1 Exports outside the UK are currently treated as domestic sales including UK VAT.
14.b2 MobCater is not currently set up for zero-rated export VAT procedures.
14.b3 VAT must be charged where the buyer arranges their own collection or courier.
14.b4 It is the customer’s responsibility to reclaim VAT via their local tax authority where applicable.
15. Quality
15.1 Goods are guaranteed under manufacturer’s warranty (usually 1 year parts only or parts & labour).
15.2 Warranty excludes wear and tear, misuse, or lack of maintenance (e.g., de-scaling).
15.3 Abuse of equipment will result in repair charges.
15.4 Defects must be reported within 3 days of discovery.
15.10 Warranty does not cover second-hand goods or loss of food contents.
15.15 Labour and travel costs for warranty repairs are borne by the buyer unless stated otherwise.
15.16 Electrical Product Recycling: WEEE disposal is not included in the price but can be arranged for a fee.
15.17 Suitability of Use: Using domestic equipment in a commercial setting will void the warranty.
16. Limitation Of Liability
16.1 Do not remove Company name plates from goods.
16.3 All implied warranties are excluded to the fullest extent permitted by law.
16.5 The Company is not liable for loss of profit or consequential damage.
17. Assignment
17.1 Buyer may not assign the contract without consent.
18. Force Majeure
18.1 No liability for failure to deliver due to events beyond reasonable control.
19. General
19.1 Customer is responsible for deciding suitability of goods.
19.3 Calls may be recorded for training.
19.6 Clerical errors may be rectified by the Company.
19.12 Governed by English Law and the jurisdiction of English Courts.
20. Communications
20.1 Disputes shall be settled by a single arbitrator.
21. Stock Availability
21.1 We aim to inform you within 1 working day if an item is out of stock.
21.3 Options include backordering, alternatives, or a refund.
22. Gas Equipment
Professional Installation: All commercial gas equipment must be installed by a Gas Safe-registered engineer. Failure to do so voids the warranty and is a legal breach.
23. Disclaimer
Accuracy: We reserve the right to amend product info without notice.

24. Customer Reviews & Feedback
24.1 The Company welcomes genuine reviews and feedback. Any review, feedback, or public comment provided by the Buyer must be based on their own genuine experience, be accurate, fair, and not misleading.
24.2 Reviews must not contain defamatory, false, abusive, discriminatory, harassing, obscene, or otherwise unlawful content. The Buyer undertakes not to publish any statement that is factually incorrect regarding the Company’s services or adherence to these Terms.
24.3 Anti-Coercion: Reviews must not be used as a threat or means of coercion to force the Company into providing refunds, replacements, or financial settlements outside of these stated Terms and Conditions. The Company reserves the right to use any correspondence as evidence to challenge and remove reviews posted under such circumstances.
24.4 The Company reserves the right to report any review that breaches these conditions to the relevant platform provider (e.g., Google, Trustpilot) and to pursue legal or contractual remedies where a review causes unwarranted reputational or financial harm to the business.
